Local AI vs Claude

Claude is technically impressive. But every prompt you send — contracts, patient data, source code, strategy memos — transits Anthropic's infrastructure. Here is what that means in practice.

🔒Privacy Local wins — zero data egress
💰Cost Local wins at volume
🧠Quality Comparable at 70B scale
⚡Speed Claude faster on weak hardware

Head-to-Head Comparison

Every dimension that matters for professional and regulated use.

What Anthropic's Policies Actually Say

Sourced from Anthropic's published usage policy and privacy notice. Current as of mid-2025.

Claude.ai Free and Pro — Conversation Storage

Anthropic's privacy policy states that Claude.ai conversations may be reviewed by staff for safety and quality purposes. Conversations are retained and may be used to improve models unless you explicitly opt out in settings. The opt-out is not retroactive.

API — 30-Day Abuse Monitoring

Even on the paid API with training opted out, Anthropic retains prompts for up to 30 days for trust and safety review. This window applies to all API tiers including enterprise. A single prompt containing MNPI, PHI, or privileged legal content exists on Anthropic's servers during this window.

CLOUD Act Exposure

Anthropic is a US-incorporated company. Under the CLOUD Act (2018), US law enforcement can compel disclosure of data held by US companies regardless of where that data physically resides. EU Standard Contractual Clauses do not override this obligation.

Claude for Enterprise (claude.ai/enterprise)

Anthropic's enterprise tier offers zero data retention and a BAA for HIPAA-eligible customers. This addresses some but not all concerns — data still transits US infrastructure, CLOUD Act still applies, and attorney-client privilege waiver arguments still apply in some jurisdictions.

Sector-by-Sector Risk Analysis

What Claude's data handling means for your specific industry.

⚖️

Legal

Sending client communications, contract drafts, or case strategy to Claude may waive attorney-client privilege under the voluntary disclosure doctrine.

Risk: Courts in the US and UK have found that disclosure to third-party AI systems can constitute waiver. No published ruling specifically addresses Claude, but the legal theory is well-established.

Local alternative: Mistral Large 2 — 128k context, strong legal drafting, zero egress.
📈

Finance

Analysts using Claude to process earnings data, M&A details, or portfolio strategies before public disclosure face material MNPI and insider trading exposure.

Risk: MNPI transmitted to any third-party system — including AI providers — creates a chain of custody problem for compliance teams. SEC guidance on AI tools is evolving rapidly.

Local alternative: Mistral Large 2 or Llama 3.3 70B on an isolated finance VLAN.
🏥

Healthcare

Claude has no BAA available on standard plans. Sending any PHI — patient names, diagnoses, treatment notes — violates HIPAA regardless of Anthropic's internal safeguards.

Risk: HIPAA penalties range from $100 to $50,000 per violation with annual caps of $1.9M per violation category. "Accidental" disclosure is not a defence once the system is known to lack a BAA.

Local alternative: Llama 3.3 70B or Mistral Large 2 on-premises.
💻

Engineering

Pasting proprietary source code, internal APIs, or unreleased product specs into Claude creates IP disclosure risk and may violate NDAs with clients or partners.

Risk: Even with training opt-out, code sits on Anthropic's infrastructure during the 30-day monitoring window. Employees who paste trade secrets may personally violate employment agreements.

Local alternative: Ollama + Llama 3.3 running in your dev environment.
👥

HR

Performance reviews, disciplinary records, salary data, and job applications contain personal data under GDPR. Sending them to Claude triggers cross-border transfer obligations.

Risk: Under GDPR Article 46, transfers to the US require SCCs or binding corporate rules. Data subjects have the right to object to automated processing — difficult to honour when data is already at Anthropic.

Local alternative: Mistral 7B or Llama 3.1 8B for lightweight HR tasks on standard hardware.
🏛️

Government / Defence

ITAR-controlled technical data, CUI, and classified-adjacent information cannot legally transit commercial AI infrastructure regardless of encryption in transit.

Risk: ITAR violations carry criminal penalties up to 20 years imprisonment and $1M per violation. "I used an AI assistant" is explicitly not a defence under State Department enforcement guidance.

Local alternative: Air-gapped deployment — Llama 3.3 70B on local GPU hardware with no network interface active.

Total Cost of Ownership

Based on a 10-person team generating ~5M tokens/month each. Claude pricing as published mid-2025.

Local AI Stack

Ollama + Llama 3.3 70B on 2× A100 80GB
Hardware (amortised 3yr)$833/mo
Power (est. 800W avg)$80/mo
Ops overhead (est.)$200/mo
Per-token API cost$0
Total / month~$1,113

Claude 3.5 Sonnet API

10 users × 5M tokens/mo = 50M tokens/mo
Input (50M × $3/M)$150/mo
Output (50M × $15/M)$750/mo
Enterprise plan base$600/mo
Hardware / ops$0
Total / month~$1,500+
Break-even point

At 50M tokens/month, local infrastructure pays for itself within the first year even accounting for hardware cost. At 200M+ tokens/month — typical for a 50-person technical team — local AI is 5–10× cheaper than Claude API pricing. Costs above exclude compliance, legal review, and DPA management overhead required for Claude in regulated environments.
